Single Expert Witness Psychology Reports for Western Australian Courts

A Single Expert Witness (SEW) is a psychologist appointed — by agreement of the parties or by order of the court — to provide a single, independent expert opinion on a defined psychological question. SEW reports are a fixture of Family Court parenting matters in Western Australia, and are increasingly used in personal injury and trauma proceedings where the court prefers one neutral expert over competing party-instructed reports. We understand that an SEW owes a primary duty to the court, not to the party who pays for the report, and every assessment is conducted and reported accordingly.

When a Single Expert Witness Is Appointed

In Family Court parenting matters in Western Australia, the court may order a Single Expert Witness psychological report where questions about a parent's or child's psychological functioning, mental health, attachment, risk, or parenting capacity are relevant to determining the child's best interests. In civil and criminal proceedings, an SEW may be appointed where the parties agree that a single, neutral psychological opinion will assist the court more than adversarial expert evidence. Our psychologists are experienced in accepting instructions under Part 7 of the Family Law Act and under the Evidence Act 1906 (WA), and in complying with the court's procedural rules, the Family Court's expert practice directions, and the Australian Psychological Society's guidelines for expert psychological opinion.

What a Single Expert Witness Report Covers

Each SEW report is tailored to the questions in the letter of instruction, but commonly includes: a structured clinical interview with the adult or child subject; psychometric assessment where indicated; review of subpoenaed material, prior reports and clinical records; formulation of diagnosis against DSM-5-TR and ICD-11 criteria; and direct, balanced answers to each question in the instruction. In parenting matters we address attachment, risk, capacity, and the child's psychological needs; in personal injury matters we address diagnosis, causation, impairment and treatment needs. Our reports are written to be accessible to the bench, robust under cross-examination, and confined to the psychologist's sphere of expertise.

We accept SEW instructions from family law firms, personal injury practitioners, government agencies and self-represented litigants in Western Australia. Joint letters of instruction are welcomed. Standard Single Expert Witness reports are delivered within 4–6 weeks of the assessment, depending on the volume of material to be reviewed; priority timeframes can be discussed.
